We have acted for both buyers and sellers of commercial, office, retail, industrial and agricultural properties, including preparing heads of agreement, undertaking legal due diligence, drafting and negotiating contracts, reviewing leases and completing settlements. We have experience with mortgagee and receiver sales, both acting for the liquidator and receivers as well as acting for the buyers.
We have assisted developers with call options, sale contracts, the land subdivision process, clearing conditions and the titling process as well as off the sale contracts and for residential and mixed-use strata projects. This work has included drafting the detailed special conditions to protect the developer and management statements, managing settlement risk, preparation of all other conditions and agreements to sell off the plan.
We have helped owners and landlords prepare and negotiate leases and deal with tenant issues. For proposed land developments we have given advice on how to structure the transaction, documented joint ventures and developed management arrangements and leases.
We have helped major tenants negotiate leases and deal with a range of issues including signage, parking and access rights, occupancy costs and rent review arrangements.
Inbound foreign investors
We have assisted foreign residents and overseas investors to help them with advice in relation to the Foreign Acquisitions and Takeover Act 1975 and obtain investment approvals if required. We have also given our clients advice on all aspects of their projects and liaised and assisted their local advisors and consultants.
